STUDENT ONE TRAVEL
2008 TOUR PARTICIPANT AGREEMENT
TERMS AND CONDITIONS

1. TOUR OPERATOR:  Student One Travel, (herein referred to as S1), located at 5080 Robert J. Mathews Parkway, El Dorado Hills, CA, 95672, contracts with major airlines and hotels, charter air service as well as wholesalers for all components of the tour package.

2. PACKAGE PRICE/INCLUSIONS: The trip price is a per person rate. All package inclusions are subject to terms and conditions contained herein. Prices listed on the fliers/brochures reflect a discount for cash payment by check or money order. All other forms of payment, including credit cards and debit cards, must add $25 (one-time) to the listed flier/brochure price. Visa, MasterCard, Discover cards are accepted. There is a $10 fee for each declined credit card transaction. Package prices are based on current rates at the time of printing and are subject to change at any time prior to departure without notice due to fuel-related increases, changes in government taxes, airline security fees, etc.

3. RESERVATIONS AND PAYMENTS: A $100 non-refundable deposit per traveler and a completed and signed registration form is required to secure a reservation. Reservations postmarked after Dec.10, 2007 must add $30 to the published prices. Final payment is due BY January 10, 2008. Late final payment risks immediate cancellation, loss of first choice hotel/flight, and is subject to late fees. Reservations made after Dec 31, 2007 require payment IN FULL by credit card, cashier’s check or money order, with completed registration form.  Checks and money orders should be made payable to Student One Travel. Receipt of deposit by S1 constitutes acceptance of these terms and conditions. There is a $30 service charge for all returned or “NSF” checks.
4. DEPARTURE TAXES/FEES: All U.S. and foreign departure taxes and fees are due with final payments. Tour participant is responsible for any changes with government taxes and fees

5. SECURITY AGREEMENT: Your payments are protected in a Clients Trust account at Wells Fargo Bank, 3935 Park Dr., El Dorado Hills, CA 95762.  CA Seller of Travel Registration #: 2071738-40

6. ROOMMATES: You choose your own roommates. S1 is not responsible for filling rooms. You are responsible for any occupancy adjustment if your roommate cancels

7. CHANGING YOUR RESERVATION: A minimum of $30 per person may apply (plus any airline or tour package imposed fees) when requesting changes to your reservation in any way once deposit has been received by S1. Any requests must be made in writing and are subject to approval.

8. CANCELLATIONS: If you cancel your reservation, your right to a refund is limited as set forth below. All cancellations and requests for refunds (if any) must be submitted in writing or faxed to S1. No refunds or cancellations will be processed from verbal requests. Cancellations received prior to the final payment due date is assessed a $100 cancellation fee. Cancellations received after January 10, 2008 receives no refund. Name changes are permitted, upon approval of request by name change form.  Name change fees will apply.  

9. INSURANCE: Optional Trip Insurance is strongly recommended for an emergency such as accident or illness, or death in the immediate family.  This Travel Protection Insurance is automatically added to all trip invoices. A copy of the relevant travel protection policy is available from S1 when requested. If you decline the policy, you must do so in writing before Jan 10, 2008.  The insurance premium is non-refundable after Jan 10, 2008. If the participant chooses to deny coverage, he/she will assume full financial responsibility for the cost of travel package price and will hold S1 harmless for any losses due to cancellation, lost luggage, or other unforeseen circumstances.

10. DOCUMENTATION: All travelers must have proper documentation for proof of citizenship when traveling outside the U.S. (see website for details). Non-U.S. citizens MUST consult their local consulates for documentation requirements. Travelers under 18 years of age must also have a notarized letter of consent signed by both parents and/or legal guardians for travel outside the U.S.  Citizenship documentation requirements are subject to change without notice. No refunds will be issued for passengers denied boarding for failure to obtain proper citizenship documentation.

11.  HOTEL SECURITY DEPOSITS: Hotels usually require $25-$100 per person security deposit upon check-in. This will be refunded by the hotel upon checkout provided that there are no charges or damages to your room.

12. MAJOR CHANGE: In accordance with the Department of Transportation Regulations, the following changes will be considered a major change entitling you to the right to cancel and receive a full refund: (1) A change in departure or return date of more than 48 hours (unless the change results from a flight delay experienced by the carrier), (2) a change in the origin or destination city for any flight leg other than a change in the order in which cities are visited, (3) a substitution of any hotel that is not named in the operator-participant contract, and (4) a price increase of more than 10% occurring 10 or more days prior to departure. If S1 becomes aware of a major change 10 or more days prior to departure, S1 will notify tour participants within 7 days of first knowing of such a change. If S1 should become aware of a change within 10 days of departure,  S1 will notify tour participants as soon as possible. Upon receiving notification of a major change, tour participant may cancel in writing within 48 hours but in no event later than departure, and receive a full refund within 14 days of canceling. If S1 gives tour participant notice of change after  departure, the participant may decline to accept the change and be sent a refund for the portion of his or her payments allocated to their hotel accommodations or transportation not provided, within 14 days after scheduled return date. Refunds offered under this contract are with the express understanding that receipt of any refund by a passenger waives any additional remedies.

13. AIRCRAFT:  A combination of both scheduled air carriers as well as charter flights are used. The charter carriers are as follows, but not limited to:  American Trans Air, Trans Meridian, Sun Country, Allegro, Ryan Air, Miami Air, Champion Air, Omni Air, Planet Airways, World Airways, Pace Airlines, Northwest and Casino Air.

14. DEPARTURE DATES, TIMES/AIRPORTS: S1 reserves the right to use Friday, Saturday or Sunday departures of the weekend chosen. Flight times are not guaranteed and may affect actual length of time in vacation destinations on travel days. The following are considered “co-terminal” airports: New York is Newark, LaGuardia, and Kennedy; Washington is BWI, National and Dulles; Chicago is O’Hare and Midway; Charlotte and Raleigh; San Francisco is San Francisco, Oakland and Sacramento.  Your airport and final trip dates will be assigned no later than 10 days prior to departure date. Any flight information provided prior to departure is considered tentative and is subject to change in accordance with operator’s option plan. It is the sole responsibility of the tour participant to reconfirm both outbound and return flights.

15. FLIGHT DELAYS: Flight delays are unfortunate, but are an inherent risk in air travel. Flight delays, missed night accommodations and expenses incurred due to flight delays, and missed connections to/from charter flights are beyond the control and responsibility of S1.  

16. FINAL TRIP DOCUMENTS: Final trip documents will be sent to you, your group leader, or campus representative 5-10 days prior to departure. Documents will not be sent until balances are paid in full. 

17. DISABILITY RESPONSIBILITY: Hotels, transportation services, and other facilities in foreign countries are not necessarily disabled accessible. If you have a disability that requires accommodations or special assistance, you must notify our office in advance. Upon written request, information will be provided to you regarding accessibility to various facilities.

18. ALCOHOL CONSUMPTION POLICY: The legal drinking age in Mexico and Bahamas is 18 years old. S1 has contractual relationships with ground tour operators in Mexico, and the Bahamas who sell optional activity packages to our travelers. S1 does not condone the use of alcohol by those under the legal drinking age and in no way condones or encourages intoxication. If you choose to drink, do so responsibly and remember that the excessive use of alcohol can result in injury and severely impaired judgment.

19. JURISDICTION AND VENUE: The terms and conditions set forth herein are governed by, and are to be construed in accordance with, the laws of the State of California. If any action at law or in equity, including an action for declaratory relief, is brought to enforce or interpret any term or condition or to enforce any right and/or legal remedy, such action must be brought in a State or Federal court in the State of California with a venue in the County of Sacramento.  

20. RESPONSIBILTY:  You understand that this trip is subject to the terms and conditions of this tour participant agreement outlined in full above with no exceptions. You further understand that S1 and its agents act solely as agents for several air carriers, hotels, land operators, bus companies, and other establishments in providing transportation, accommodations, and services offered in this tour. Therefore, in absence of negligence on its part, S1 shall not be responsible for any accident, injury, damage, death, loss of vacation time, expense, inconvenience, loss of wages, distress or frustration whether physical or mental, due to an act of negligence or default of any carrier, restaurant, hotel, tour or ground operator or any persons rendering any of the services included in this tour or losses due to mechanical breakdowns, government actions, act of Nature, act of terrorism, delay or cancellation of travel due to inclement weather, theft, strikes, or other circumstances beyond our control; the failure to obtain required travel documentation; the failure to follow instructions, including, but not limited to, reconfirming flight times, etc.. In the event of a hotel overbooking or other situation necessitating an accommodation change, S1 will provide equivalent or upgraded accommodations or refund the difference.

21. PARTICIPANT RESPONSIBILITY: You are responsible for your actions on the entire tour, beginning and ending with air flights. Activities are not mandatory; they are voluntary.  Your decision to participate is not actionable against S1 or USA. Inappropriate behavior can be cause for eviction from the program and to be sent home at your expense. No refund will be issued for unused flights, accommodations, or other tour services if the passenger leaves the tour for any reason. S1 employees are NOT chaperones. By participating in our trip, S1 retains the right to use your photo or likeness for promotional purposes unless otherwise expressed in writing. S1 cannot be responsible for lost or misdirected mail. Changes and updates in your address and/or phone number must be submitted in writing.

22. SHARING OF INFORMATION: Because our travel services are offered in conjunction with the services of other companies such as airlines, hotels, and other tour operators, S1 may be sharing your personal information with those companies. S1 may also share this information with other non-related companies, unless you inform S1 in writing that you do not consent to sharing of your information to non-related companies.
